Kperogi: ENetSuD Appeals Court Ruling on Locus Standi

•                   Says it needs not suffer any injury before suing government

ENetSuD has filed an Appeal at the Ilorin Judicial Division of the Nigerian Court of Appeal.

The Appeal is to challenge the ruling of Hon. Justice S.M. Akanbi who declared that ENetSuD does not have the locus standi to sue the Kwara State House of Assembly, Government, Speaker, Governor and others over the ‘illegal’ appointment of Hajia Halimat Jummai Kperogi as contract Clerk to the Assembly.

In the notice of Appeal, ENetSuD maintained that as a Civil Society Organization pursuing public interest litigation, it does not need to show any special injury suffered by the ‘illegal’ appointment of the Clerk before it is clothed with locus standi.

ENetSuD asked the Court to set aside the ruling of the High Court and hold that it has locus standi to sue the government on the wrong act.

It is worthy of note that since 24th May, 2023 that Hon. Justice S.M. Akanbi delivered his Court ruling, the copy of the ruling has not been made available to enable ENetSuD to exercise its right of Appeal.

ENetSuD informed the Court of Appeal that additional grounds for the Appeal would be filed whenever the judgement and records of proceedings at the High court are received.
