2017 SCHOOL CONSTITUENCY PROJECTS IN KWARA STATE: A PRELIMINARY REPORT OF ENetSuD INVESTIGATION
BACKGROUND
The Elites Network for Sustainable Development (ENetSuD), a Kwara-based Civil Society Organization (CSO) was established with the primary aim of promoting good governance and ensuring transparency and accountability. Part of our approach towards ensuring good governance in the state is to enlighten the public to take active part in policy formulation, campaign against corruption, expose corrupt practices, advocate for transparency and accountability in leadership, protect citizens’ rights, and evaluate/monitor the implementation and performance of Kwara state-related budgets.
- We initiated a #FollowKwaraMoney project, so that #KwaraMoneyMustWorkForKwarans. As part of the activities of this project, we have written Freedom of Information (FOI) requests to ALL the Federal Ministries, Departments, and Agencies (MDAs) that executed the 2017 Zonal Intervention (Constituency) Projects (ZIPs) in Kwara state. Particularly, we wrote Universal Basic Education Commission (UBEC) via various letters ENetSuD/FOI/ZIP/01/3, ENetSuD/FOI/ZIP/01/13, and ENetSuD/FOI/ZIP/01/18. In addition to the MDAs, we also copied all the Federal Legislators from Kwara state that nominated the ZIPs in the National Budget so as to keep them abreast of our ongoing monitoring of the projects that they nominated on our behalf as citizens of Kwara. The Kwara state office of UBEC referred us to its headquarters in Abuja. We wrote the headquarters and received a response on 18th September, 2018 after a reminder.
- Using the responses gotten from UBEC and Sen. Abubakar Bukola Saraki (ABS) Constituency office, we have visited some of the project locations to ascertain if they were executed or not, and to also see the extent to which they have been executed.
- This first edition of our report will cover the findings by our Investigation team during our assessment visits to the locations of 30 out of 52 schools listed by ABS Constituency office.
OVERALL FINDINGS
Our findings are tabulated in the attached annex 1. The pictorial evidences of our findings are also displayed in the annex 2. In general, we observed the following:
- Most of the projects visited by us, though completed, were not properly executed. The poor execution has prevented usage by communities in some cases. Those currently being used might not last long. It was very obvious that the work done could not commensurate with the contract sum.
- ABS Constituency office reported construction of 3 classrooms with boreholes and generators for Ten (10) schools, while UBEC reported only 2 classrooms in all the schools. However, our visit to the schools validated the description provided by ABS Constituency office, and negated that of UBEC. This is a pointer to the fact that ABS constituency office unexpectedly has superior information on project description and execution over UBEC.
- The amount provided to us by UBEC as the contract sum seemed to be the same for those schools where we found 2 classrooms with furniture and in those where we found 3-classrooms with furniture, borehole and toilets. This unrealistic scenario points to the fact that there could have been contract sum inflation in those projects with 2 classrooms and furniture (which are the highest in number)
- There were discrepancies between the project status reported by UBEC and ABS Constituency office. The former reported 100% completion while the latter reported 90% for the projects under consideration. This shows that there is no coordination and feedback between both of them as regards the school projects.
- Comparison of the data provided by UBEC and ABS Constituency office suggested that they did not both have accurate data of the project they executed and nominated respectively. The former provided 70 projects while the latter provided 52 projects. Some of the classroom projects locations provided by ABS Constituency office were not known to UBEC, and some of the project locations provided by UBEC were not also known to ABS Constituency office, as they were not found in their listed schools. However, our comparison of responses from both parties resulted in a total of 83 projects.
- The ABS constituency office could be said to be involved in the execution of some projects. For instance, some 23 projects related to distribution of furniture and books to some schools that amount to Three Hundred and Five Million, Nine Hundred Thousand Naira (N305,900,000) were reported by UBEC to be located at ABS Constituency office in Mandate. We have written the ABS constituency office to ask questions concerning these projects.
- Some of the companies that got the contract award from UBEC were not found on the portal of Corporate Affairs Commission
- In some cases, the companies that got the contract award from CAC were not the actual companies that executed the projects
ENetSuD POSITIONS
- Though the contract sum might be the approved ones by the Agency during the contract award, we are of the opinion that they are too outrageous compared to the projects executed
- The projects, though reported to be completed by the executing agency (UBEC), were not properly executed, and there is no value for the huge public money spent on them
- The contractors that executed the projects should be directed to return to site and fix the identified faults as stated in our findings in Annex 1.
- Projects nominated during the budget process by elected lawmakers and funded by government should be explicitly named as such. Putting the name of lawmaker who nominated the projects as “Sponsor” or “Facilitator” will misinform the public to mean that the project was “funded” from the pocket of such lawmaker. This will prevent an individual to take credit for a project fully funded by government from taxpayers money
ENetSuD RECOMMENDATIONS
- The elected lawmakers, in addition to nominating projects for the benefit of their constituents, should keenly and properly monitor UBEC during the execution of their nominated school projects. Doing this in the interest of their constituents that elected them will ensure that quality works that commensurate with the contract sum are done for their electorates that they represent.
- The UBEC (which is the executing Agency) should meticulously supervise the contractors and do a thorough qualitative assessment and monitoring of the works done before paying the contractors and issuing job completion certificates. Using certified experts (Engineers) for this quality assurance monitoring is highly recommended.
- Elected legislators should always give details of nominated projects to the communities where the projects will be implemented. This will help citizens to have adequate information on the projects.
- Community-based associations and school teachers are strongly encouraged to also #GetInvolved in the inspection of any project brought to their communities and schools respectively, for quality assurance purpose, and report any observed dissatisfaction to their elected representatives and UBEC before the contractors leave the project site.
- The outrageous contract sums being paid to the contractors need to be reviewed in contract awards to reflect the reality in project costs. The excess amounts that might be saved from this could be used for other projects that will benefit tax-payers, instead of using it to enrich contractors.
